Terms of Service

These Terms of Service ("Terms") govern your access to and use of beGraphic, a web product available at begraphic.dev. By creating an account or subscribing, you agree to these Terms.

1. The service

beGraphic is an AI-assisted video editing product. It has two parts.

Auto Cut. You upload your own footage (talking clips). We transcribe the audio, use AI to select which parts to keep and in what order, and assemble an edited video with animated captions. You can revise the result by editing the transcript directly or by describing the change in words.

Motion graphics. You provide a prompt and visual choices; we generate a video using parameterized compositions and code-based rendering. You can edit scenes live in your browser.

Both parts export 9:16 / 1080×1920 / 30 fps MP4 files. How we handle footage you upload is set out in §5 below and in our Privacy Policy.

2. Eligibility

You must be at least 18 years old to use beGraphic, or the age of majority in your jurisdiction, whichever is greater. By using the product, you represent that you meet this requirement.

3. Subscriptions and pricing

beGraphic is a paid product with no free tier. Plans:

• Creator: $50/month or $144/year, 600 tokens per month.
• Max: $78/month or $288/year, 1000 tokens per month (fair-use cap).
• Starter (legacy): $15/month or $120/year, 300 tokens per month. Closed to new subscriptions. If you are already on Starter you keep the plan, the price, and the token grant until you cancel or switch plans.

We also offer additional billing terms from time to time, and the prices above are the standard monthly and annual rates rather than an exhaustive list. The plans, billing terms and prices available to you are the ones shown at begraphic.dev/pricing and confirmed at checkout before you pay. A token grant is per month and does not change with the billing term you choose.

Tokens are consumed when you generate or export videos, in both Auto Cut and motion graphics. What a job costs depends on its length and complexity, and an Auto Cut job scales with the amount of footage you upload, so how many videos a grant covers varies with how you use it. The cost of each job and your remaining balance are shown in the product. Live edits to an already-rendered video do not consume tokens. Token grants reset at the start of each billing period and do not carry over. Subscriptions renew automatically until cancelled. You can cancel anytime from your account settings (Studio → Account & billing). Your subscription remains active until the end of the current period.

Promotional and introductory pricing. Any discount, promotional code, or reduced price applied at checkout covers only your first billing cycle, unless we state otherwise at the time of purchase. Where an introductory offer is available it is applied automatically at checkout, and how much it takes off depends on the plan and the billing term you choose - longer terms carry a larger introductory discount, so the gap between the introductory price and the renewal price is wider on them. Not every plan or billing term carries an introductory offer; the price you will pay, and the price you will be charged when the subscription renews, are both shown at checkout before you pay. The length of the discounted cycle is the billing term you chose, not one month. If you buy a three-month term the discount covers those three months, and if you buy a twelve-month term it covers those twelve months. When the discounted cycle ends, your subscription renews automatically at the standard rate for the plan and term you chose, as shown at begraphic.dev/pricing. By completing a purchase with a discount applied, you agree to that renewal price. You can cancel before the next charge at any time from your account settings.

Prices are in USD and exclude applicable taxes. We may change prices with at least 30 days' notice; existing subscriptions continue at the existing price until the next renewal.

4. Refunds

We offer a 14-day money-back guarantee on your first subscription period. Email contact@begraphic.dev within 14 days of your first charge for a full refund, provided you have used fewer than 100 tokens. If you have used 100 or more tokens, or the 14-day window has passed, charges are non-refundable. Renewal charges are also non-refundable, but you can cancel future renewals at any time from your account settings. There are no forms and no retention process - one email is enough.

5. Your content and rights

You retain all rights to the footage you upload, the prompts and styling choices you make, and the videos you create. We claim no ownership.

Footage you upload. You are responsible for having the rights to the footage you upload, including the consent of anyone appearing or speaking in it. Do not upload material you do not have the right to use.

You grant beGraphic a limited license to process your inputs so we can provide the service. In practice that means: storing your uploads and renders so you can work with them and download them; sending the audio from your uploads to our speech-to-text provider to produce the transcript that drives the edit and the captions; and sending prompts and transcripts to our AI provider to decide the edit. Our current providers are named in the Privacy Policy. This license exists only to run the service and ends when you delete the project.

Retention. Raw uploads are deleted on an automatic schedule: 7 days after you export a cut, or 30 days if you never export it. Deleting a project removes its stored content.

Commercial use is allowed. Renders are watermark-free on every plan. You can use them in social posts, ads, product marketing, or any commercial context.

6. Acceptable use

You agree not to use beGraphic to:

• Generate content that is illegal, defamatory, or violates third-party rights (including IP, privacy, or publicity rights).
• Generate content depicting real people without their consent.
• Generate sexually explicit content, content sexualizing minors, or content promoting violence or hate.
• Reverse engineer, scrape, or programmatically abuse the product.
• Resell access to your account or share credentials.
• Attempt to extract our system prompts, model weights, or proprietary infrastructure.

Violations may result in immediate account termination without refund.

7. Service availability

We aim for high uptime but do not guarantee uninterrupted service. Maintenance, third-party outages (Anthropic, AWS, Stripe, Supabase), or unforeseen issues may cause downtime. We do not offer SLA credits for the v1 product. If a render fails due to our infrastructure, the consumed tokens are refunded automatically.

8. AI output disclaimer

AI-generated outputs may occasionally produce unexpected results. You are responsible for reviewing a video before using it publicly. We don't guarantee that a render will match your intent on the first attempt, which is why live editing exists.

This applies to Auto Cut in particular. The transcript is produced by automatic speech recognition and may contain errors, and the AI decides which parts of your footage to keep and which to drop. Review the cut and the captions before you publish them. We are not responsible for meaning changed or lost by an automated edit.

9. Account termination

You can delete your account anytime. We may suspend or terminate accounts that violate these Terms, that we believe are fraudulent, or that have payment disputes. On termination, we delete your data per our Privacy Policy.

10. Disclaimers and limitation of liability

THE SERVICE IS PROVIDED "AS IS". TO THE MAXIMUM EXTENT PERMITTED BY LAW, BEGRAPHIC DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

IN NO EVENT WILL BEGRAPHIC'S TOTAL LIABILITY EXCEED THE AMOUNT YOU PAID IN THE 12 MONTHS PRECEDING THE CLAIM. WE ARE NOT LIABLE FOR INDIRECT, INCIDENTAL, OR CONSEQUENTIAL DAMAGES.

11. Governing law

These Terms are governed by the laws of the jurisdiction in which beGraphic is incorporated, without regard to conflict-of- law principles. Any disputes will be resolved in the courts of that jurisdiction.

12. Changes

We may update these Terms. Material changes will be announced by email at least 14 days in advance. Continued use after the effective date means you accept the new Terms.
